By accessing the Website, booking any Service, or otherwise using our Services, you ("you," "your," or "User") agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must not access the Website or use our Services.


These Terms constitute a legally binding agreement between you and Emergency Vet Transport, a family-owned business operating in Chatham-Kent, Ontario, Canada. We recommend that you print or save a copy of these Terms for your records.

Our mission is to serve as a dependable link between pet owners' homes and essential veterinary or relocation destinations.

2. Eligibility and User Representations

To use our Services, you must:

Have the legal authority to enter into these Terms.

Provide accurate, complete, and current information during booking or registration.

By using our Services, you represent and warrant that:

You will maintain the accuracy of such information.

You will comply with all applicable laws, regulations, and these Terms.

You are the legal owner or authorized guardian of the pet(s) being transported.

We reserve the right to refuse or terminate Services to anyone for any reason, including if we believe you have violated these Terms.

 

 

3. Booking and Service Provision

 

3.1 Booking Process

All bookings require our confirmation, which includes a detailed quote based on factors such as service type, distance, pet size, urgency, and any additional requirements (e.g., after-hours service). Quotes are provided honestly with no hidden surprises. Pre-booking is strongly recommended to ensure availability, as we cannot guarantee immediate service without prior arrangement.

 

3.2 Service Descriptions

 

We offer the following Services, each designed with pet safety and comfort in mind:

 

Emergency Transport (FAST):

Starting at $99.99 CAD. For urgent, time-sensitive situations requiring immediate pickup and transport to a veterinary facility. We prioritize direct routes and rapid response.

 

Scheduled Vet Appointments:

Starting at $44.99 CAD. For routine or planned visits, ensuring timely arrival and return.

 

Safe Long-Distance Transport:

Starting at $74.99 CAD. For extended trips, with emphasis on comfort, regular breaks (if applicable), and secure handling.

 

House-to-House Relocation:

Starting at $49.99 CAD. For local moves, providing calm and secure transport between residences.

 

All Services include:

 

Secure carriers for comfortable and safe containment.

 

Climate-controlled vehicles to maintain optimal conditions in all weather.

 

Trained handlers experienced in animal care to ensure gentle, stress-free journeys.

 

Sanitized equipment and cautious driving practices.

 

 

3.3 Modifications, Cancellations, and No-Shows

 

Modifications:

We may need to modify Services due to unforeseen circumstances (e.g., weather, road conditions, vehicle maintenance, or pet health issues). We will notify you promptly and offer alternatives where possible.

 

Cancellations by You:

You may cancel a booking with at least 24 hours' notice for a full refund. Cancellations within 24 hours may incur a fee up to 50% of the quoted amount. No refunds for no-shows.

 

Cancellations by Us:

We reserve the right to cancel Services at any time for reasons including but not limited to safety concerns, legal requirements, or operational issues. In such cases, we will provide a full refund and reasonable notice where feasible.

 

No-Shows:

If you are not present or prepared at the scheduled pickup time, we may charge a no-show fee equivalent to the full service cost.

 

 

4. Payment Terms

Pricing: All prices are in Canadian Dollars (CAD) and are subject to change without notice. Quotes include base rates but may add fees for extras such as large pets, multiple animals, after-hours service, taxes, or fuel surcharges.

 

Payment Methods: We accept credit cards, e-transfers, and cash. Payment is due upon booking confirmation or at service completion, as specified in your quote.

 

Refunds: Refunds are issued only for cancellations as outlined above or due to our error. No refunds for completed Services, even if outcomes differ from expectations.

 

Disputes: Any payment disputes must be raised in writing within 7 days of the invoice date.

 

 

5. User Responsibilities and Obligations

To ensure safe and effective Services, you must:

 

Provide complete and accurate details about your pet(s), including breed, size, age, health conditions, behavior, vaccinations, and any special needs.

 

Ensure your pet is healthy enough for transport (except in emergencies) and provide any required documentation (e.g., health certificates for long-distance trips).

 

Supply appropriate carriers or crates if not using ours; all pets must be securely contained during transport.

 

Be available at pickup and drop-off locations or designate an authorized representative.

 

Comply with all local, provincial, and federal laws regarding pet transport, ownership, and welfare.

 

Notify us immediately of any changes to your booking or pet's condition.

 

Failure to meet these responsibilities may result in service denial, additional fees, or termination of these Terms.

 

 

6. Limitation of Liability

IMPORTANT: THIS SECTION LIMITS OUR LIABILITY TO YOU. PLEASE READ CAREFULLY.

To the maximum extent permitted by applicable law, Emergency Vet Transport, its owners, employees, agents, affiliates, and representatives shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages whatsoever arising out of or in any way related to:

 

The use or inability to use the Website or Services.

 

Any loss, injury, illness, death, or harm to your pet(s) during or as a result of transport, including but not limited to accidents, escapes, health complications, stress-related issues, or interactions with other animals.

 

Damage to property, vehicles, third parties, or personal belongings.

 

Delays, interruptions, cancellations, or failures to meet scheduled times due to traffic, weather, mechanical issues, or other uncontrollable factors.

 

Any outcomes from veterinary care or relocation following our transport.

 

Errors, omissions, or inaccuracies in information provided on the Website or during booking.

 

Unauthorized access to or alteration of your data.

 

You acknowledge and agree that pet transportation inherently involves risks, including but not limited to road hazards, pet anxiety, pre-existing health conditions, and unforeseen events. By engaging our Services, you voluntarily assume all such risks and waive any claims against us.

 

WE PROVIDE THE SERVICES "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED SERVICE.

 

In no event shall our total aggregate liability to you exceed the amount you paid us for the specific Service giving rise to the claim. This limitation applies regardless of the legal theory (contract, tort, negligence, or otherwise) and even if we have been advised of the possibility of such damages.

 

Some jurisdictions do not allow certain limitations of liability, so the above may not apply to you in full. However, our liability will be limited to the greatest extent permitted by law.

You agree to indemnify, defend, and hold harmless Emergency Vet Transport, its owners, employees, agents, affiliates, and representatives from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your pet's behavior, health, or any issues during transport.

Your breach of these Terms or any representations made herein.

Violation of any law or third-party rights.

Any content or information you provide.

This indemnification obligation survives the termination of these Terms or your use of the Services.

10. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes arising out of or related to these Terms or the Services shall be resolved exclusively in the courts located in Chatham-Kent, Ontario. You agree to submit to the personal jurisdiction of such courts.

 

Before pursuing legal action, you agree to attempt informal resolution by contacting us in writing. If unresolved within 30 days, either party may initiate formal proceedings.

 

 

11. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, strikes, governmental actions, or utility failures.
